What Is The Process For Filing For A Kentucky Divorce?

To begin a divorce in Kentucky, at least one spouse must have lived in the state for a minimum of 180 days before filing. The process starts with submitting a “Petition for Dissolution of Marriage” in the county’s Circuit Court where either spouse resides. This petition must then be served on the other spouse.

Once the petition is filed, couples must address important matters such as child custody, child support, property division and spousal maintenance. If everything is agreed upon, the process moves forward as an uncontested divorce. If there is disagreement on any issues, it becomes contested and may require court involvement.

Kentucky follows a “no-fault” divorce rule, meaning it is enough to state that the marriage is irretrievably broken; no one needs to prove wrongdoing. If the couple has children, the court generally requires at least a 60-day waiting period before the divorce.
