Judge Hall acquitted: Guthrie True secures major federal victory

A jury cleared Pike County Circuit Judge Howard Keith Hall of all federal charges after a weeklong trial in Frankfort. Prosecutors accused Hall of mail fraud and theft of government funds tied to an alleged payroll scheme during his time as Pike County attorney. Prosecutors claimed he paid a part-time assistant more than $440,000 despite the assistant doing little or no work. They also alleged Hall received over $500,000 from that attorney’s private practice.

Earlier this year, the Kentucky Judicial Conduct Commission temporarily suspended Hall after the indictment and a separate public reprimand. After hearing the evidence, the jury found no proof of wrongdoing. Immediately after the verdict, the Commission met and unanimously lifted Hall’s suspension, allowing him to return to the bench. Judge Eddy Coleman recused himself from that vote.

A decisive defense victory

Guthrie True, founding partner at True Guarnieri Ayer LLP and one of Kentucky’s most respected lawyers represented Hall at the trial. True emphasized throughout the case that Hall’s conduct was lawful, pointing out that Kentucky law places no minimum workload requirement on part-time county attorneys and allows them to maintain private practices.

After the verdict, True said:

“I’m extremely happy for Judge Hall and his family. They’ve been through a great deal since the indictment was returned in April. I’m just so pleased that they have some relief from this nightmare.”

True said the payments were legal and that prosecutors never proved they were part of a scam. He told jurors the government did not show any evidence the money was fraudulent. He also pointed out the accusations came during Hall’s bitter 2020 campaign, a “nasty election,” as one witness called it, suggesting politics may have played a role.

What does the verdict mean for the community?

With his acquittal, Judge Hall is back on the bench as one of two judges who handle felonies and big civil cases in Pike County. His return closes a high-profile case that drew attention across the state. The trial also raised questions about federal fraud laws, what county attorneys should be doing and how public service can mix with private law work.

Reflecting on the outcome, True noted, “High-profile cases like this demand patience, preparation and courage. Judge Hall had all three.”
