Kentucky remains one of the safer states in the U.S., ranking 44th for violent crime. Still, some offenses occur more frequently than others and affect communities across the state. The latest Crime in Kentucky reports show which crimes happen most often. Knowing this information can help residents stay informed, protect themselves and take the right steps if they or a loved one face criminal charges. Here are three of the most common crimes in the state of Kentucky.

1. Larceny-theft

Larceny-theft is the most common crime in Kentucky, making up roughly 69% of all property offenses. This category includes shoplifting, pocket-picking, and thefts from vehicles, with about 930 reported incidents per 100,000 residents each year. While theft remains widespread, it has dropped nearly 10% in 2024 compared to the prior year.

The law treats theft based on the value of the stolen property. Low-value thefts are usually misdemeanors, which can result in fines or up to one year in jail. Higher-value thefts are felonies and carry longer prison sentences, along with restitution requirements.

2. Drug and narcotic offenses

Drug-related crimes continue to make up a large portion of serious offenses in Kentucky, with 47,293 offenses in 2024. Even with an 11.5% decline in reported cases, they remain a significant concern.

Possession of certain controlled substances, like methamphetamine, LSD or PCP, is a first-degree offense in Kentucky. It is a Class D felony and can carry up to three years in prison. For first or second offenses, judges often allow alternatives such as deferred prosecution or probation. Convictions can also affect employment, housing and other opportunities.

3. Assault

Assault is the state’s most common violent crime. Aggravated assault accounts for roughly 65.4% of violent offenses.

Kentucky law separates simple from aggravated assault. Simple assault may lead to fines or short jail time, while aggravated assault, especially cases involving weapons or serious injury, is a felony with potential long-term imprisonment.

Understanding crime and your rights in Kentucky

Property crimes dominate Kentucky’s legal landscape, but violent crimes carry serious consequences. Understanding the prevalence and penalties of these offenses helps residents make informed choices. If you or someone you know is facing criminal charges, consulting an experienced criminal defense attorney can provide guidance and improve the chances of the best possible outcome.

A jury cleared Pike County Circuit Judge Howard Keith Hall of all federal charges after a weeklong trial in Frankfort. Prosecutors accused Hall of mail fraud and theft of government funds tied to an alleged payroll scheme during his time as Pike County attorney. Prosecutors claimed he paid a part-time assistant more than $440,000 despite the assistant doing little or no work. They also alleged Hall received over $500,000 from that attorney’s private practice.

Earlier this year, the Kentucky Judicial Conduct Commission temporarily suspended Hall after the indictment and a separate public reprimand. After hearing the evidence, the jury found no proof of wrongdoing. Immediately after the verdict, the Commission met and unanimously lifted Hall’s suspension, allowing him to return to the bench. Judge Eddy Coleman recused himself from that vote.

A decisive defense victory

Guthrie True, founding partner at True Guarnieri Ayer LLP and one of Kentucky’s most respected lawyers represented Hall at the trial. True emphasized throughout the case that Hall’s conduct was lawful, pointing out that Kentucky law places no minimum workload requirement on part-time county attorneys and allows them to maintain private practices.

After the verdict, True said:

“I’m extremely happy for Judge Hall and his family. They’ve been through a great deal since the indictment was returned in April. I’m just so pleased that they have some relief from this nightmare.”

True said the payments were legal and that prosecutors never proved they were part of a scam. He told jurors the government did not show any evidence the money was fraudulent. He also pointed out the accusations came during Hall’s bitter 2020 campaign, a “nasty election,” as one witness called it, suggesting politics may have played a role.

What does the verdict mean for the community?

With his acquittal, Judge Hall is back on the bench as one of two judges who handle felonies and big civil cases in Pike County. His return closes a high-profile case that drew attention across the state. The trial also raised questions about federal fraud laws, what county attorneys should be doing and how public service can mix with private law work.

Reflecting on the outcome, True noted, “High-profile cases like this demand patience, preparation and courage. Judge Hall had all three.”

About Guthrie True: A national leader in white-collar defense

Guthrie True is known as one of the nation’s premier trial lawyers. He focuses on white collar criminal defense, high-stakes federal litigation and complex civil matters. He was elected to the American College of Trial Lawyers, a distinction reserved for roughly the top 1% of trial attorneys nationwide. He is also a Fellow of the International Academy of Trial Lawyers, one of the most selective legal honors in the country.

True has handled more than 100 jury trials and won many acquittals and dismissals. He has defended clients in some of Kentucky’s most high-profile cases. He often represents people and companies in federal probes. For example, health-care fraud, campaign finance, tax issues and even public corruption. His work has led to published decisions in the Kentucky Supreme Court, the Kentucky Court of Appeals and the U.S. Court of Appeals for the Sixth Circuit.

Known for his skill, tenacity and commitment to his clients, Guthrie True continues to be a trusted advocate for individuals facing the full weight of the federal government.

Williams that felons with non-violent prior convictions may have a pathway to restore their gun rights. The case involved a defendant, Williams, who challenged the constitutionality of a federal statute that barred him from possessing firearms due to a non-violent felony conviction. The court found that the statute, as applied to Williams, violated his Second Amendment rights, setting a precedent that could impact many in similar situations.

Non-violent convictions are different

This decision recognizes that not all felonies are equal in terms of their threat to public safety and that individuals who have served their time and demonstrated rehabilitation should not be indefinitely deprived of their constitutional rights. The ruling opens the door for these individuals to petition the court for the restoration of their gun rights, provided they can demonstrate that they do not pose a danger to society. They must also meet other conditions.

Other criteria for petitioning

If you’re looking to restore your gun rights in Kentucky, here are the key eligibility criteria you need to meet:

Completion of sentence: You must have received a final discharge or completed your sentence, including any probation or parole.

No pending charges: You should not have any pending charges, outstanding warrants, or indictments.

Restitution and fines: You must not owe any outstanding restitution or fines.

Demonstrated rehabilitation: Evidence of rehabilitation includes maintaining steady employment, participating in community service and obtaining character references.

Let us be your guide to restoring your gun rights

If you (or someone you know) qualify, now may be the time to petition the court to restore your gun rights. Legal professionals specializing in this area can provide guidance and support through the process, helping to navigate the complexities of the legal system and present a compelling case for the restoration of rights.

Proving the essentials of a breach of contract claim is crucial for any Frankfort business owner who needs to make things right after another party's damaging actions. Here's what you need to prove to ensure success in a breach of contract case.

Elements of a valid breach of contract claim

To establish a breach of contract in court, it's imperative to demonstrate these three core elements:

Existence of a valid contract: A legally binding contract must be proven to exist. This means the agreement should have clear terms, mutual assent, and consideration. It should comply with both Kentucky state laws and broader legal principles. A written and signed contract is usually the strongest proof that an agreement existed, though an oral contract can be enforced too.

Breach: A breach occurs when one party does not honor a term of the contract. This could be a failure to perform on time, a complete failure to perform, or performance that does not meet the agreed-upon terms. The breach must be material, meaning significant, for the claim to succeed.

Damages suffered: Proving that a breach occurred is not enough for the plaintiff to win at trial. They must show that they suffered damages like financial losses or other forms of harm directly resulting from the breach.

For example, let's say a clothing supplier contracts with a retail store to deliver 100 blue T-shirts by April 1. If the delivery does not arrive until April 21, that could be a breach of contract. It could also be a breach if the delivery contains towels instead of T-shirts, or if the supplier never sends anything at all. The store would lose out on potential revenue from T-shirt sales, for which they could seek compensation from the supplier.

Remedies for a contract breach

When a breach is established, various remedies are available:

Damages may be awarded to place the non-breaching party in the financial position they would have been in if the breach had not occurred. This is the most common remedy sought in breach of contract lawsuits.

Specific performance may be ordered, compelling the breaching party to fulfill their contractual obligations.

Cancellation and restitution might be pursued to return the non-breaching party to their original position prior to the breach, effectively canceling the contract.

Consult with a business litigation attorney

Every breach of contract claim is unique, and the nuances of the law can be complex. It is wise to seek the counsel of a seasoned business litigation attorney to discuss the specifics of your case.

Alison Lundergan Grimes, who served as Kentucky's Secretary of State from 2011-19, was declared not guilty by Judge Phillip Shepherd of the Franklin Circuit Court. The judge noted that the state’s Executive Branch Ethics Commission’s final order did not dispute that Grimes would have lawful access to the voter data and missed several other key issues.

The allegations

The state's ethics watchdog had accused Grimes of downloading voter lists onto a flash drive for a private purpose without paying the mandatory fees or submitting sworn forms required by law. The commission had investigated Grimes for several years, announcing in November 2021 that Grimes must pay $10,000 in fines for two ethical violations pertaining to her handling of that voter data.

The defense

Grimes argued that the voter information she accessed was already publicly available, and as the Secretary of State, she had the complete legal right to use and distribute it. She maintained that her actions did not break any laws or rules.

Her lawyer, firm partner J. Guthrie True, described the ruling as a "full exoneration for Grimes." Another member of her legal team, Jon Salomon, emphasized that the court found no serious breaches of ethics laws, suggesting that the charges were unfounded and that Grimes was merely performing her duties.

The judge’s verdict

Judge Shepherd's 33-page order sided with Grimes, noting that the statute of limitations had expired on the commission's charges and that there was no evidence to support the allegations of ethical violations. The judge found that the commission did not provide a clear argument or evidence for its claims, casting doubt on the validity of the accusations. The judge also criticized the Ethics Commission for not holding a proper hearing to examine the evidence more thoroughly.

Grimes responds to the ruling

Grimes hailed the judgment as a win for her team and their work. A Democrat and Lexington attorney, Grimes was an unsuccessful candidate for the U.S. Senate in 2014 against Republican Mitch McConnell. She is the daughter of former state Democratic Party Chair Jerry Lundergan.

Running for office in Kentucky requires you to be knowledgeable about the campaign process, including understanding the campaign finance requirements. There are many regulations on how campaign funds can be used and how often you must report information about your campaign’s funds. While these rules can seem cumbersome, they exist to help maintain fair elections and prevent candidates from gaining unfair advantages.

Filing campaign finance documents

All state candidates are required to file campaign finance documents with the Kentucky Registry of Election Finance. Before raising money for your campaign, you must file with the Kentucky Secretary of State. You also need to file forms indicating who will act as your treasurer and which financial institution you will be using for your campaign funds. There are two situations in which you will be allowed to request an exemption from reporting the funds you raise during your campaign.

The first exemption is for anyone who doesn’t intend to raise or spend more than $1,000 during their campaign. If this applies to you, you don’t have to file any pre-election or post-election financial documents unless your funds exceed $1,000. The other exemption is for those who wish to raise or spend less than $3,000. With this exemption, you’re only required to file the 30-day post-election report.

Campaign funds in excess of $3,000

If you plan to raise or spend more than $3,000, you must file multiple reports at designated time periods during your campaign. These include a 32-day pre-election statement, a 15-day pre-election statement, a 30-day post-election statement and a 60-day post-election statement if you have a surplus of funds or debt owed on the 30-day post-election statement. An annual report may also be required if you have surplus funds or debt on your 60-day statement.

Each of these reports must include details of the contributions to your campaign. These details include information about the person or entity who contributed, the address of the contributor, the amount contributed and other information. The reports should also list in detail how your campaign is spending those funds.

Legal questions or concerns

Campaigning for office in Kentucky comes with much responsibility, especially when pertaining to the way one collects, spends and reports funds. Failing to follow the regulations associated with campaign finance requirements could lead to legal trouble. If you’re facing accusations about misuse of funds or have questions or concerns about a related issue during or after your campaign, you can benefit from speaking to an attorney so that you know how best to protect yourself.

Medicare fraud is a serious offense that can cause life-changing repercussions with a conviction. Those who work in healthcare, especially when dealing with Medicare cases, must be particularly careful to follow the regulations when filing paperwork and completing other Medicare-related tasks. Healthcare workers already have many stresses when it comes to doing their jobs each day without being accused of fraud. Understanding Medicare fraud can help you understand how to avoid these types of accusations and give you information on what to do if you are accused of committing Medicare fraud.

Common types of Medicare fraud

Many Medicare fraud accusations are based on billing practices. As a healthcare worker, you likely work hard to ensure that your paperwork is filed properly so that the patient’s medical bills reflect the treatment they received. Double billing, where a patient is charged twice for medical care, is a common type of Medicare fraud. Phantom billing, where the patient is charged for a procedure that did not occur, is also considered fraudulent.

Other types of Medicare fraud are related to upcoding, where a procedure is improperly coded to increase the billed costs of the procedure. Unbundling, where bundled procedures are separated so they can be billed separately, is also fraudulent. Receiving kickbacks, performing unnecessary procedures and not keeping the required medical documentation can also fall under Medicare fraud.

What to do if you’re accused

An accusation of Medicare fraud could harm your reputation, leading you to lose your job as a healthcare provider. Even when you’re accused and not yet convicted, others in your field may ostracize you, and you may have trouble finding a new job in the future. When accused of fraud, it’s important to seek legal advice promptly. You’ll need to have information about the specifics of the accusations so you’re able to defend yourself against those accusations.

As a healthcare worker, you’re likely under a lot of pressure to maintain records and keep everything documented as required. Healthcare workers are human, which means, like everyone else, mistakes do happen. Honest mistakes related to Medicare filing, billing and procedural work don’t necessarily mean that fraud was committed. Know that you will be allowed to present your evidence to give your side of the events that happened.

Seek legal advice

Fraud in the healthcare industry is taken very seriously, as it can affect patients, healthcare workers and insurance companies. Facing charges of fraud can be scary, but you’re not alone. Seek the advice of someone knowledgeable in Medicare fraud cases so that you’re prepared to defend yourself against the charges.

However, as you are probably aware, going through a divorce is now viewed in a much more positive fashion and as a way to move forward toward a brighter future. In many of these instances, both here in Kentucky and across the nation, former partners have been able to establish amicable relationships post-divorce, which can especially prove invaluable when there are any children involved.

With couples deciding to end their marriages becoming more prevalent over the past several decades, there has also been an increase in studies and surveys that track the divorce rate -- both nationally and on a state-by-state basis. Data recently released by the U.S. Census Bureau shows Kentucky as one of the states with the highest divorce rate. Some interesting specifics from this survey include the following:

The overall divorce rate for the entire United States rose by 3.6% from 2021 to 2022.

Over the past decade from 2011-2021, the divorce rate for our country has actually declined by 27%.

Southern states represented more than half of the 10 states with the high divorce rates in 2022.

Kentucky had the third highest divorce rate of any state in 2022, trailing only Wyoming and Arkansas.

More specifically, approximately 9.9 out of every 1,000 women surveyed in the state of Kentucky reported they had gotten divorced at some point during 2022.

Even though the negativity surrounding the ending of a marriage has substantially diminished to a point where it’s close to nonexistent in many cases, there are still many potential challenges and complex issues you could encounter during the divorce process.

Fortunately, there is professional help and support readily available to help guide you through these matters, including property division, child custody, child support, spousal maintenance and much more. An experienced Kentucky family law attorney can answer all of your questions and concerns, protect your future best interests and increase your odds of achieving the best divorce settlement possible.

Facing criminal charges is a serious threat to one’s future. If convicted of a crime, it can lead to penalties that may affect every area of your life. Potential consequences include time behind bars, expensive fines, a permanent mark on your criminal record and much more. It could also affect your future job opportunities, your personal reputation and even an ongoing child custody case.

It is important that you take your situation seriously if you are facing criminal charges. Regardless of the allegations against you, you have the right to defend yourself and to pursue the best possible outcome to your situation. Recent statistics indicate that the rates of arrests and criminal charges has dropped overall in the state of Kentucky, but it is still beneficial to know what to do in case you are ever investigated, questioned, arrested or charged.

A closer look at crime rates

It can take time for statistics to begin to reflect changes in arrests and the overall crime rate, but some of the most recent crime reports indicate that the rate of serious criminal events in Kentucky have decreased over the last few years. Law enforcement views this as an encouraging sign as it may indicate that enforcement and community vigilance is working. There are fewer violent crimes, including murder, robberies and drug offenses, with the overall rate decreasing by approximately 10%.

The 2022 crime report indicates that, from 2021 to 2022, there was a significant decrease in the number of crimes in 23 different categories. The overall number of arrests also decreased by just over 6%, and other types of crime and arrests related to fraud, human trafficking, prostitution and obscene material also decreased. One of the areas of crime that did increase in both case reports and arrests was animal cruelty.

After an arrest

The implications of an arrest and criminal charges are serious. You would be wise to take your situation seriously and seek legal guidance as soon as possible after an arrest. An attorney can provide insight regarding the legal options available to you, as well as how you can develop an effective defense strategy. An assessment of your situation is the first step to understanding how you can fight for your future interests.

A retailer is recalling thousands of bath seats over risks that they can collapse, causing fall and laceration injuries to users.

According to the U.S. Consumer Product Safety Commission (CPSC), importer Steamist received 62 reports of the shower seats breaking due to corrosion. Of those 62 cases, four led to injuries.

The seats were manufactured in China and sold at specialty plumbing supply outlets from June 2009 through February 2015. The recall affects some 3,900 seats.

CPSC advises all consumers with the shower seats to immediately stop using them and contact Steamist to determine if their seats are part of the recall.

Bath seats as assistive devices

Bath seats, also called shower seats or chairs, are specialized furniture designed to help the elderly and people with difficulty standing up to bathe. Bath seats are supposed to be safe and durable to use, made with waterproof materials such as stone, plastic, or even treated wood.

However, Steamist’s seats were prone to corrosion. Users might suddenly fall when their corroded bath seat falls apart, suffering fall injuries and cuts from sharp edges. This can be especially dangerous for the elderly and users with physical disabilities, who are the main consumers of bath seats.

Filing a product liability lawsuit for a defective bath seat

Kentucky law outlines product liability actions for defective design, manufacturing defects, and inadequate warnings or instructions.

However, there can only be a product liability case if the injury, death or property damage caused by the product occurred either within five years after the date of sale or eight years after the date of the product’s manufacture.

If you have suffered a defective bath seat injury, you should first seek medical attention. Once you have recovered, document everything: your medical expenses, treatments, and even pictures of the damaged seat. Once you’ve collected as much evidence as possible, consider seeking a legal professional. A lawyer can help determine if you have enough evidence for a product liability lawsuit and even represent you in court.
