Are expert witnesses appropriate for divorce proceedings?

Divorce is difficult, and one of the most difficult portions of the process is the hearing. Even if the negotiations between spouses go swimmingly, a hearing before the court is necessary and the couple’s faults and failures are laid bare.

When the negotiations don’t go well and you believe you need to prove to the court your side of the argument, your attorney may suggest you call in an expert witness.

There are a variety of expert witnesses that could be at your disposal. They include:

Child experts – Therapists or psychologists who specialize in children can offer testimony on what might be in the best interests of the child.

Real estate experts – Experts in market value can offer testimony in divorces that involve high-value property.

Forensic accountants – These experts can ferret out and report on hidden assets or undervalued property and businesses.

Vocational experts – When the amount and length of spousal support is in question, these experts can testify on how much a spouse can earn.

There are many other types of experts that can be called depending on the specifics of your situation.

Expert witnesses can be expensive, so the net gain needs to be evaluated before you decide to call an expert before the court. If the issue is property of middling value, or hidden assets that don’t amount to much money, then the cost of hiring an expert witness may not be cost-effective.

If you are going to be in a difficult divorce, it is in your best interest to have a qualified, experienced attorney on your side. Seek out such an attorney to give you the advice you need.
